Miami Personal Injury Lawyer
If someone else's negligence put you in a hospital, you should not be negotiating with their insurer from the recovery room. We build the case, deal with the adjusters, and fight for the full value of your claim.

Denied, delayed, or underpaid? If you did not sign a release, you may still be owed more, even if you already cashed a check or paid for repairs yourself. We handle the claim end to end, including reporting the damage.

Meet the attorney
Daniela Leyva, Esq.
Founder & Managing Partner
Daniela Leyva concentrates her practice on personal injury and first-party property insurance litigation, representing injured people and homeowners against insurance companies, and has successfully litigated numerous claims on their behalf. She knows how stressful these disputes are, and she gives every client the time and attention their case deserves.
Her path to the law began at a prominent Miami personal injury firm, where five years of helping clients as an assistant convinced her she could do more as an attorney. She earned her Juris Doctor from St. Thomas University School of Law in 2017, clerking for two judges of Florida's Eleventh Judicial Circuit and interning with the City Attorney of Coral Gables along the way. Before founding Leyva Law, P.A., she also practiced family, immigration, consumer protection, and community association law.
Born and raised in Miami and proudly Cuban-American, Ms. Leyva is fully bilingual and represents clients in English and Spanish. Outside the office she trains in mixed martial arts, takes on DIY projects, travels, and spends time with her husband, family, and their Rottweiler and Boxer.

How it works
Three Steps. One of Them Is Yours.
-
1
Tell Us What Happened
Call, text, or book a free consultation. We will tell you honestly whether you have a case.
-
2
We Take Over the Claim
The paperwork, the deadlines, the adjusters, the recorded statements: all of it becomes our problem instead of yours.
-
3
We Fight for Full Value
We negotiate hard, and when the insurance company will not pay what the claim is worth, we file suit and litigate.
Common questions
Frequently Asked Questions
How much does it cost to hire Leyva Law?
Nothing upfront. The consultation is free and we work on contingency, which means our fee is a percentage of what we recover for you. If there is no recovery, you owe no fee and no costs.
How long do I have to file a claim?
Florida law sets strict deadlines for both lawsuits and insurance claims, and policies add their own notice requirements. Waiting too long can end an otherwise strong case, so contact us as soon as possible after an accident or loss.
My claim was already denied or underpaid. Is it too late?
Often it is not. If you did not sign a release, you may still be entitled to additional compensation, even if you cashed the insurer's check or started repairs out of pocket. We review denials and underpayments at no cost.
Will I have to go to court?
Most cases settle without a trial. But insurers pay more when they know your lawyer is willing to litigate, and we are. If the offer does not reflect what your case is worth, we file suit.
What should I do right after an accident or property damage?
Get safe, document everything with photos, and see a doctor if you are hurt. Before you give the insurance company a recorded statement or accept any offer, talk to a lawyer. That first call is free.
